Alexandre Boero January 25, 2019 at 12:5361 The Linky counter, which is still struggling to be accepted, is the subject of legal action by a Lyon collective, which has initiated proceedings against the company Enedis (formerly ERDF), which installs the devices. Between Linky and users, it has never been true love. As proof, Monday, January 21, a hearing in summary proceedings took place at the Tribunal de Grande Instance of Lyon. On the initiative of the Info Linky Sud Ouest Lyonnais collective, the procedure aims to stop the installation of the famous connected meter , gradually installed by the Enedis company throughout the territory.
Several dozen plaintiffs associated with the procedure
Sandrine Larizza, member of the collective, reminds the local newspaper Lyon Capitale that “the Linky electricity meter is not compulsory”. For her, “we must stop the forced poses. Our collective is solicited by many people who are terrified by the attitude of Enedis”.The company began installing the connected meter in 2010 in Lyon. But the discontent persists and anti-Linky users did not hesitate to come together to join the request filed with the TGI. "This hearing is special because it brings together the feelings of 150 plaintiffs," says Edouard Raffin.
Representatives of anti-Linky and Enedis opposed to the use of personal data
In his plea, the collective's lawyer points out that "Linky was not designed in the interest of users but to allow Enedis to enter big data" (remember, as we told you on Clubic it a few months ago, the various smart meters are rather fond of personal data). Maître Raffin is offended: “That would make Linky the first connected object imposed. It is a violation of the free choice of citizens”. According to him, "the billions of data used by Enedis are worth gold". EDF, the parent company of Enedis, could thus turn its users' connected data into a profitable business. monthly is a basis for being able to pay electricity bills". It also recalls that the private data of users cannot be transmitted to a third party without their agreement, each person being able to check directly on their online space if they have consented to offer their data and proceed with their withdrawal. Finally, Maître Le Chatelier bases himself on the Energy Code to affirm that a clause allows Enedis to have access to the meter and the possibility of repairing it, changing it and replacing it. Two versions therefore oppose each other, and the deliberation will be delivered on February 18, 2019. Two similar procedures have also been initiated in Drôme and Ardèche.
